These Terms of Service (“Terms”) govern your use of the website unitseastbay.com and the moving and portable-storage services provided by UNITS Moving and Portable Storage of the East Bay (“UNITS,” “we,” “our,” or “us”). By using our website, requesting a quote, or booking a UNITS container, you agree to these Terms. If you do not agree, please do not use our services.

1. Services

UNITS provides portable-storage container delivery, on-site storage, warehouse storage, and local and long-distance moving services throughout the East Bay and surrounding California service area. The specific services, container sizes, delivery windows, and pricing applicable to your engagement are defined in the written quote or reservation confirmation we issue to you.

2. Quotes, reservations, and payment

Quotes are valid for the period stated on the quote. A reservation is confirmed only after we accept your booking and, where applicable, you authorize the deposit or first-period rental charge. Ongoing storage is billed on a recurring period basis as disclosed at the time of booking. Late payments may result in suspension of access, late fees, or, after notice as required by California law, enforcement of the lien described in Section 6.

3. Cancellation and rescheduling

You may cancel or reschedule a delivery, pickup, or move by contacting us as early as reasonably possible. Cancellation and rescheduling fees, if any, are disclosed at the time of booking and in your confirmation. Deposits are refundable as stated in your quote.

4. Access, site conditions, and delivery

You are responsible for ensuring that the delivery and pickup location has safe, legal, and adequate access for our trucks and containers, including compliance with any HOA, municipal, or property-management rules and obtaining any required permits. UNITS is not responsible for damage to driveways, lawns, pavement, sprinklers, overhead lines, or other property reasonably incidental to placement and removal of a container at the location you designate, except where such damage results from our negligence.

5. Prohibited items

You agree not to store or ship any of the following in a UNITS container: hazardous, flammable, explosive, toxic, or radioactive materials; firearms, ammunition, or explosives; illegal drugs or controlled substances; live animals or plants; perishable food; items subject to spoilage, mildew, or infestation; cash, securities, jewelry, precious metals, furs, art, or collectibles of extraordinary value; and any items the possession of which is prohibited by law. You are solely responsible for the contents you place in the container.

6. Your property, risk of loss, and insurance

Your property remains your property at all times. Risk of loss or damage to items stored in a UNITS container remains with you unless caused by our negligence or willful misconduct. We strongly recommend that you maintain homeowner’s, renter’s, or separate storage insurance covering the full replacement value of the items you store. Any UNITS “protection plan” or coverage offering we make available is limited to the terms, exclusions, and per-item and aggregate limits disclosed at the time you elect it. Nothing in these Terms is insurance issued by UNITS.

To the extent permitted by California law, including the California Self-Service Storage Facility Act (Cal. Bus. & Prof. Code §§ 21700 et seq.) where applicable, UNITS has a lien on the contents of your container for unpaid rent and other charges and may enforce that lien in accordance with the statute after required notice.

7. Limitation of liability

To the maximum extent permitted by law, UNITS’ aggregate liability arising out of or relating to your use of our website or services is limited to the amounts you paid to UNITS for the service giving rise to the claim in the twelve (12) months preceding the event. UNITS is not liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits, loss of business, or loss of data. Nothing in these Terms limits liability that cannot be limited under California law, including liability for gross negligence, willful misconduct, or personal injury.

8. Website use

The content on our website is provided for general information about our services and is not a guarantee of availability, pricing, or fitness for a particular purpose. You may not scrape, reverse engineer, disrupt, or attempt to gain unauthorized access to any part of the website. All logos, trademarks, images, and content are the property of UNITS or its licensors and may not be copied or reused without permission.

9. Privacy

Your use of the website and our services is also subject to our Privacy Policy, which is incorporated into these Terms by reference.

10. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. The exclusive venue for any dispute arising out of or relating to these Terms or your use of our services is the state or federal courts located in Alameda County or Contra Costa County, California, and you consent to personal jurisdiction in those courts.

11. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date at the top of this page reflects the most recent revision. Material changes will be posted on this page, and your continued use of the website or services after such posting constitutes your acceptance of the revised Terms.
